Terms and Conditions
The following clauses constitute all the terms and conditions of the transportation contract entered into between the client and Luxury Tours LLC.
Refunds, Changes & Cancellations
- At the time the travel ticket is issued, the client expressly accepts and fully acknowledges the following general contracting clauses and the fare table in force at the time of issuance of the referred ticket.
- If the passenger communicates the cancellation of their trip with a minimum of 4 to 5 hours notice before the scheduled departure time, a refund equivalent to 50% of the ticket price will be issued.
- If the cancellation is made with less than 5 hours notice before departure, no refund of any kind will be provided.
- The fares published on the website and other means required by sector regulations are for reference only and may vary according to the characteristics and conditions under which the service is offered, without prior notice due to the nature of the service and/or the conditions under which it is provided.
- The travel ticket is personal and may only be transferred at the Passenger’s request (i) upon prior identification; (ii) payment of the applicable administrative fee; and (iii) payment of the fare adjustment, if the new ticket has a higher fare. If the new ticket has a lower price, there will be no refund of the difference.
- Children under five (05) years old must be registered at the counters before boarding.
- Infants are not entitled to a seat, luggage, meals, changes and/or refunds.
- Children over five (05) years old pay full fare.
- Passengers over 70 years old and minors are prohibited from traveling in panoramic seats.
- The Passenger is responsible for verifying that the data stated on the Travel Ticket matches their request at the time of purchase. Therefore, subsequent claims will not be accepted.
- The Passenger is required to provide complete, truthful, and verifiable information during the purchase process. Luxury Tours LLC shall not be held responsible for false, incomplete, or inaccurate information provided.
- In case of loss or change of the ticket, the Passenger may request a duplicate, subject to payment of administrative fees.
- Boarding and disembarking of passengers will only take place at authorized Terminals or Stations.
- Luxury Tours LLC will make available to the Passenger the bus in which they will be transported at the chosen time, and therefore, the Passenger must arrive thirty (30) minutes before the departure time.
- If the Passenger does not show up at the boarding time and date indicated on the ticket or does not carry the physical and valid ticket and ID, the Passenger will automatically lose the right to travel and the value of the ticket.
- Boarding times at stopovers are referential, as the bus is in transit and subject to factors beyond Luxury Tours LLC’s control.
- Minors traveling alone or accompanied by third parties other than their parents must present a valid notarial or legal authorization.
- Children under 12 years old must travel accompanied by their parents or an authorized adult.
- Changes and postponements (in person by the ticket holder) will be accepted up to 4 hours before the departure time stated on the ticket, subject to fare adjustment in case of a fare increase. Postponements are valid for a maximum of 45 calendar days from the original travel date.
- The Passenger is entitled to 20 kilos of luggage. Excess will be allowed when capacity permits, subject to additional payment.
- Luxury Tours LLC is not responsible for valuables not declared at boarding and transported as luggage.
- Loss, partial or total damage to luggage in the cargo hold will be covered according to the National Transport Administration Regulations.
- Luxury Tours LLC is not responsible for the loss of cabin luggage; its safekeeping is the responsibility of the Passenger.
- The Passenger may not carry weapons or objects prohibited by law. They must allow luggage and personal checks.
- Passengers with SUCAMEC licenses must facilitate the packaging and custody of their weapon at the Luxury Tours LLC office.
- Traveling under the influence of alcohol, drugs, or in an inappropriate health condition is not permitted unless a medical certificate is provided. Otherwise, the ticket value will be forfeited.
- Delays caused by unforeseen events, force majeure, holidays, or heavy traffic do not generate liability for Luxury Tours LLC for any damages caused.
- If events prevent the service, Luxury Tours LLC will arrange a transfer to a standard bus or refund the unused portion if transfer is not possible.
- Luxury Tours LLC is not responsible for failure or interruption of additional benefits offered as courtesy (WiFi, screens, etc.).
- It is prohibited to transport in the cabin animals (except certified guide dogs), weapons, explosives, flammable materials, chemicals, and substances.
- Luxury Tours LLC does not provide cash refunds, only postponements under the stated conditions.
- The Passenger is insured through a personal accident insurance policy (SOAT) subject to legal conditions and agreements with the insurer.
- Disputes will be resolved in the Courts of the city of Lima, as agreed jurisdiction.
General Conditions for Cargo and Parcel Transport
- The client must present their Identity Document to proceed with the shipping request.
- The client must truthfully declare the goods being shipped. Luxury Tours LLC may verify the declared information.
- The client is responsible for proper packaging, labeling, and recipient details.
- Prices may vary depending on weight, volume, and destination, even if there is a standard rate table.
- The transportation of drugs, weapons, flammable materials, explosives, corrosives, poisons, products restricted by SENASA, DIGESA, INRENA, SERFOR, pornographic material, human remains, valuables, tangible money, and others prohibited by law is strictly forbidden.
- Fruits and/or vegetables subject to SENASA control are not accepted; Luxury Tours LLC is not responsible for undeclared or prohibited shipments.
- Luxury Tours LLC does not verify the content or internal condition of shipments.
- Perishable shipments must be picked up on time; otherwise, Luxury Tours LLC may dispose of the goods due to decomposition.
- Shipments are kept for 30 calendar days from arrival; after this period, they will be considered abandoned and may be destroyed without the right to claim.
- In case of loss, misplacement, or damage, Luxury Tours LLC is governed by Article 146 of the National Railway Regulations, paying ten times the value of the freight charged.
- For delivery, the recipient must present an original identity document, enter a security code, and sign the acknowledgment of receipt; they may make observations if not satisfied.
- Legal entities must present an original power of attorney with shipment details and the authorized third party, along with the required identity documents and knowledge of the security code.
- Luxury Tours LLC assumes no responsibility for criminal acts, impersonations, or incidents beyond its control, including unforeseen events or force majeure, strikes, wars, accidents, seizures, civil disturbances, etc.
